To the best of my knowledge, models do not generally get photo rights.
Signing a waiver usually means you are agreeing to give up such things.
Whether the surf guitarist is Jon Martin, Johnny Fain, or anyone else, in all due respect, some amount of proof is needed.

Sounds like a good subject for a local news or TV reporter to cover.

HERE YA GO! Courtesy of Randy Nauert of The Challengers! Randy has an amazing Facebook page. It's worth signing up just to check out his pics alone! The man has an incredible wealth of knowledge! All hail Randy!
Here's what Randy says...
This is Jon Martin. On the left is the finished ad as it appeared in 1965 and as it appears at the new Fender Visitor's Center in Corona, next to the factory. On the right is on the shore. Notice Pacific Coast Highway and the lagoon.
I spoke with Jon a few days ago. We'll be visiting in Newport when he returns from Idaho in a few months. The photo was taken at Doheny, in one ride. Jon knee paddled out with the new Fender "Jaguar" and caught a wave, stood up and swung it around for this photo. When he came ashore, they put the guitar back into its case and box and sold it.
The shore shot has never been posted, printed or shared until right now. Its from the contact sheet of outtakes. I have more but hoped that this would put to rest any of the false claims and misinformation that abounds.
There's a Beach Boys show at the Visitor Center now with a lot more photos that you've never seen before. http://www.fender.com/visitor-center/

Incredible find! Kudos to Norm and Randy. If the Fender museum is paying attention (or cares), they owe you a debt of gratitude too.

Well, Randy did say he was going to be hangin' with him in a few months. Maybe he'll talk him into doing a re-shoot!
Mega props to Randy for sharing this amazing stuff!

This a great thread for all us Fender fans!!!
Everybody loves the ad!
Also thanks to shivers13 for best detective work!
I want new pics with John Martin catching a wave on a board complete with all my more than 30 guitars!! I am sure HE could do it!
...and, yes I also would like to have THAT Jag!!!
I would give three or four other Jags for it!
— Twang cheers!
