To the best of my knowledge, models do not generally get photo rights.
Signing a waiver usually means you are agreeing to give up such things.
Whether the surf guitarist is Jon Martin, Johnny Fain, or anyone else, in all due respect, some amount of proof is needed.

Here's what Randy says...

This is Jon Martin. On the left is the finished ad as it appeared in 1965 and as it appears at the new Fender Visitor's Center in Corona, next to the factory. On the right is on the shore. Notice Pacific Coast Highway and the lagoon.

I spoke with Jon a few days ago. We'll be visiting in Newport when he returns from Idaho in a few months. The photo was taken at Doheny, in one ride. Jon knee paddled out with the new Fender "Jaguar" and caught a wave, stood up and swung it around for this photo. When he came ashore, they put the guitar back into its case and box and sold it.

The shore shot has never been posted, printed or shared until right now. Its from the contact sheet of outtakes. I have more but hoped that this would put to rest any of the false claims and misinformation that abounds.
