The whole key to trademark law is "first use" in what's known as
the "stream of commerce"
So all of the advice I have been reading is accurate and helpful
Be the first one, that's priority #1
And "stream of commerce" as suggested includes many avenues, such as
a website, selling merchandise over the internet, even at live gigs
Have a PRENENCE - be there FIRST, and ensure that you have done
something in a "commercial sense"
but the registry is surely the strongest protection you can offer
yourselves (akin to Federally copyrighting your songs)
sssshhhhhh don't tell anyone UNSTEADY FREDDIE is actually a duly
licensed lawyer in New York State (since 1987) -- enough people
aren't talking to me as it is!
found the websites and links info quite informative too - thanks!
good luck in your "venture" (ooops, isn't that a trademark for some
surf band or something?) HAHAHA
