Outer Limits

Wow,
A question I can answer!
The song was originally released as Outer Limits,
A TV show along the lines of The Twilight Zone.
"Do NOT try to adjust your TV sets...
We have control of your vertical, we have control of
Your horizontal, because you have entered the outer
Limits."
Anyways, they got the heat from the lawyers from the
TV Show, and they had to re-issue the 45's. I had both
Of them, could not afford buying albums back then.
Outer Limits >>> Out of Limits
Another Rock and Roll Group with the same problem...
"The Little Rascals" had to change their name to "The Young Rascals"
And the Platters had to change
"Bark, Battle and Ball" to "Shake, Rattle and Roll"
Because the former was to "Suggestive"

i got a question on this whole copyrighting, trademark
thing.
now "outer limits" is two dictionary words, how can
they claim that they own this phrase ? its not its an
invented word like "jello" or "frisbee". and thier not
even in the same business, its not like 2 TV shows are
called outer limits.. does anyone know how this works
?

You'd have to go back and retrieve the original court documents to have
your questioned answered for certain. I know that you can't copyright
titles. So, the lawsuit that forced Warner Bros. to change the song's
title probably was not a copyright infringement lawsuit. I don't know the
applicable legal terms, but it was likely some kind of intellectual
property complaint, that the song did not represent the TV series and could
mislead the public, doo dah, doo dah.
The lawsuit may never have happened if "Outer Limits" had been released on
an independent label and quickly lapsed into obscurity. For additional

That's a good point. I think the only way the lawsuit could have been brought
about wouldbe againt the title in association with the Out of Limits riff. The
riff being too close to the T.V. theme and so the pair of them would be the
infringement. But I don't recall if the riff really is close to the Outer
Limits T.V. theme.

The riff was not close to the Outer Limits TV show theme. In fact
strangely enough it is similar to the Twilight Zone TV show theme.

exactly!
it is clearly a tease riff from the TWILIGHT ZONE
the issue (legally) probably was over a TRADEMARK -- the owner of the
mark accusing someone else of trying to 'trade off' their mark
at the time the show was fairly popular so the lawyers for ABC/MGM
probably felt strong enough to throw out a 'cease and desist' letter,
and it worked...not sure if there was actually a lawsuit? doubt it; in
fact in a full-fledged lawsuit I think the TV show would not prevail
trademark law can be most frustrating
for example, Toyota couldnt release their LEXUS at first because the
legal research company LEXIS stopped it; but the appellate courts
wisely said one can't possibly confuse a car with a research company
the key to understanding trademark law is this---a consumer
is 'confused' (or tricked) into thinking 2 different products are FROM
THE SAME COMPANY/SOURCE (they the consumer doesnt have to actually know
what that source is)
this is why CADILLAC CAT FOOD can co-exist with the car
remember the PHILCO company? they chased my gradfather (named Philip)
who started a little company in the garment center called PHILCO...he
didnt want to fight them so he changed the name
ED SULLIVAN successfully sued a TV REPAIR SHOP with the name ED
SULLIVAN'S TV REPAIR SHOP or something like that (that was the guy's
name! and he had to change it!)
one of my favorite lawsuits for trademarks (are you listening POLLO DEL
MAR?) involves the makers of CHICKEN OF THE SEA (canned tuna) suing a
manufacturer of canned chicken called TUNA OF THE FARM -- I think they
prevailed!
it's probably the most 'fun' part of the law/litigation (if there is
a 'fun' part!)
