Hello friends! i am going to record an album with my band and i have thought about using some soundclips from different movies in some of the songs, like in the beginning of a song for example. which i think could be pretty cool..like Secret Samurai that begin their song Dont fear the reverb with something that sounds to me is a sounclip from a movie..
i just wanted to ask if any of you guys know how these things work..do one need permission from the moviemakers to use soundclips from their movies?

The Legal answer is yes, you need permission, or have ot pay for it.
But if you use obscure clips from old movies, i'm sure you would never get caught.
Man Or Astroman used alot of old 50's and 60's B-movie sci fi films.
I'm sure they never got popped.

ahh..so using something from Batman is out of the question..how about using clips from videos on Youtube then? i found a video with Oppenheimer where he talks..could one use something from that? i think it was recorded in 46 or something..

Being that most surf bands are pretty small in the big picture,
you could use something from Starwars and George Lucas would probably never know.
But it all depends on if you want to chance it.
I'm not sure about you tube, I would say prob. not legally,
but wtf? go for it.

I'm not a legal expert by any stretch of the imagination, but I believe that
one CAN sample movies, etc., if the sample is under several (seven?)
seconds.
Then again, I could be wrong.
Hell, Skinny Puppy sampled the HELL out of Legend of Hell House
on several of their albums. . . . Not to mention tons of others.
I, for one, have sampled the hell out of Blue Velvet, Return of
the Living Dead, and Twin Peaks, for what it's worth. Granted, I
haven't sold anything, so. . . .

The bottom line is if you use a sample, no matter what length, you need permission, and you will have to pay. That's the legality of sampling. Some duplicators will not copy your CD without proof of consent.

Actually, "DiscMakers," the company that manufactured and duplicated our CD would not allow us to use it without written consent. We couldn't get it so we ended up taking it out...it's still on the myspace page though

Yeah, in my experience unless you're using something from the public domain, its just not worth the hassle. I chose to use DiscMakers as the duplication house for our CD and they happen to audit your entire CD prior to beginning production. If there is any "questionable" copyright protected material in there, they'll make you jump through all the legal hoops.
It seems that since 2005, a new anti piracy law was enacted and a lot of companies are paying extra special attention to this issue. I tried to contact the current distributer of the film I sampled (Fatal Flying Guilletine) and they never returned my phone calls or emails, so I just decided to pull the sample and get on with finishing up the CD. I was kind of bummed, but oh well.
Cool site, Varelux, I'll definitely look at what's available there for the future.
