I miss Phil Dirt being on KFJC... does anyone have of his show recordings from back in the day to share? Smile

Funny, I just saw an ad for a cassette player, like a walkman, with a USB out, and this was the first thing I thought about doing if I had one- converting Dirt's old shows. I have about 25. Would put them on SoundCloud.

Ferenc, that would be so awesome if you ever do transfer them... and Brian, if they're recordings off-air and not sold anywhere, I'd think it's fair game. We're not profiting, we're sharing.

It's up to you. But I would think it would be ok, since KFJC archives their own shows anyway? I'm pretty sure I downloaded it from their site.

Yeah but we have no right to distribute their material without permission. If you ask them and get back to me I'll consider it.

It looks like KFJC archives the past two weeks, which is in compliance with the Digital Millenium Copyright Act (other features of their archives aren't, but most stations pick and choose anyway because the law is outdated). I've read through that part of the DMCA a bunch because I've been trying to implement the same feature for our station.

I really don't think it's legal. Radio stations pay royalties on the songs they play and I don't think those royalties would be covered in the same way if those songs could be listened to on-demand.

That said, I think there's basically zero actual risk. Mixcloud exists and people repost their air-broadcasted radio shows there all the time. At the very worst I think you're looking at a cease and decist, but even that seems pretty unlikely given the copyright holders.

Legal issues aside, god it would make me so happy to see an archive of Phil Dirt's shows come to light. I discovered surf in high school through Phil's program, which I adored. Tuning in every Saturday was a seriously formative experience. I still have a few cassettes of my own, and it gives me goosebumps whenever I occasionally dust them off and listen. Talk about nostalgia!

To see a repository of those shows (including live Pit performances?) would be such a gift. I hope it could happen somehow with Phil's and KFJC's blessing.

Response from Phil Dirt... which I interpret as "go for it!"

The legal answer is that all broadcast programming is copywritten upon transmission and protected by federal law. It's highly unlikely there would be any actual risk. I would be very surprised if KFJC objected, and I have no objection. I suggest posting them on archive.org so anyone can listen.

Talked to the appropriate expert at KFJC. Here is what he wrote.

"If someone else has recordings of Phil Dirt's shows and puts them somewhere that we have no control over, then we're not liable." We, in this case, means KFJC.

So if you have recordings of old shows and place them somewhere like archive.org, you would be liable if one of the artists on the records that were part of the show got annoyed. It's up to you if you think that is unlikely. Of course, you should ask Phil Dirt's permission.

KFJC is generally happy to let listeners help to get the word out about what we do, but we appreciate the courtesy of crediting the DJ and the station if you use any of our stuff - such as posting a video from the KFJC Surf Battle on YouTube.

I have most for April 2004 through October 2005 in my iTunes. Some of it would drop out because of a lousy network connection. If we find a home for them it would be great. How about TheArchive.org?
