I have to rant a little bit.........Why is it that everytime I think up a cool name for a band, I end up cussing my computer screen after I type that name into google? It is a little bit frustating.....ugh.....

So what if I used a name that has been used before? The name I am considering is not an over used one, but there is one band out there using it.

Don't use any name with "Los" in it! The more ridiculous the better I suppose. Something like, "The Blissandos?" Most likely the only way you would face legal issues is if the other band started to become nationally famous. Then they might try to assert a trademark right to the name. —Plus! Keep trying! It worked for me with "the Aquatudes." Thought it up a few years ago, did a Google search, and found nothing remotely musical with the name (and almost nothing-period). Then I secured the "aquatudes.com" domain right away and was off and running. I'm sure others have similar stories with their band-names. —http://www.aquatudes.com |

If there's no conflict of interest, then no problem. The other band may split up while you end up releasing 17 albums in your career. You could always add the letters TX after your name. Since we decided to call ourselves The Nematoads, I've found a few bands around the world with the same name. A few years ago, I sent one of them a myspace friend request. I didn't say anything to them at all other than, "Cool that we have the same name. I like your music." They took it upon themselves to change their name to The Undubious Nematoads, and we ended up releasing a split CD-EP together. —Ted James |

If I recorded an EP with that name, with a completly different style of music than the "other" band, could I face any legal issues? Should I just go back to the drawing board? What was the deal with the Surfaris?
