Thanks for the suggestions, but taking the easiest course of action, I'll probably just lop the sample off the beginning. It's not exactly a work of art.

Certainly learned a lesson when it comes to nabbing film samples for my songs. Or at least, nabbing film samples and trying to upload them to iTunes.

Another 2 cents from me- One of the immediate benefits with signing on with Sharawaji was the assurances, in writing that any material covered by my band would have the copy-write issues addressed. Mike is all about getting rights, protecting my rights ie original material and a myriad of other legal nuances. I know he has posted on this topic in the past. It's not just the song or other intellectual property, it's the country published or played in, which types of right are assigned, duration etc.

And there are whole threads on this site addressing these issues. And yes, it can be pretty daunting.

That type of blanket copyright law is antiquated. It should be as easy to clear a sample from a movie as it is to record a cover of a song. There is just no easy way to do it.

Your best options are as follows:

  1. Cut the samples completely for any retail or distributed release
  2. Only if you want to take a gamble, produce a very limited run of CDs with samples for sale direct to fans at gigs and keep them well away from distributors and retailers.
  3. Have very few assets.
  4. Wait for cease and desist letters
  5. If any lawsuit happens use it as marketing material.

Even if you re-record the samples with voice actors you would probably also be infringing copyright in the sequence of the words.

I dealt with MGM recently and got a similar blanket rejection letter.

I'm actually quite surprised any MoAM? albums are on iTunes. It looks like their earlier material is not, which may explain that.

I wasn't expecting WB to release anything, least of all for free. I was expecting some kind of dialogue over what their terms were, the blanket ban approach was a surprise. Because deep down I know that if Justin Bieber wanted a sample their response wouldn't be an instant 'no'.

Yes that kind of thing, actually that sounds like a line from one of the Carry-On movies! I think "you don't have the authority" comes from a British comedy called "The Office" a program I have never watched even though I like Ricky Gervais. It's a catch phrase which took off like a rocket in my local area. In any case it suits da-ron's dilemma.
