hey...it's all cool surfdaddy... maybe we can write our respective US congresspeople and express our views re: webcast radio and the CRB? hey...is the Internet public (or private)? I think in the US, public R&D money went into the development of the US section of the Web...but, in other countries, the Web is under government control (ie China)... any takers? is there an international copyright organization that will hear our plea? |

A real enterprising lawyer could probably put together a very winable class action law suit against BMI, ASCAP and the other one. Here's how it works. Each of these companies send bills to radio stations etc, and they have to pay the bill or wind up not playing any artists they represent. I know, I used to be a GM for a radio station. Theoretically, every artist (or copyright owner) that gets played is supposed to recive like 12 cents or something everytime their song is played. What actually happens is a few times a year the radio stations sends in their weekly playlist and they see what was played that week and average it over the course of the year. Then they divide out the royalties among the artists played that week. And they get all the money. There is always a bunch left over, so they take the left overs and pay them out as bonuses to artists like Elton John, Gwen Stephani, etc who get a lot of air play that they want to make sure stay with them, especially if they show promise of putting out future records and hits. This left over money, generally is owed to small bands who occasionally show up on these play lists that aren't worth writing a $20 check to. It's kind of like that Superman movie where Richard Pryor steals the 1/2 pennies and becomes a millionaire. In short, I say screw those bastards. Many Web broadcasts play independent music and small bands who will never see a dime. I could go on, but I'll stop now and may post more later. Spanky |

When it comes right down to it, if you play primarily independent bands that you could actually contact, they almost always own the rights to the song. I don't see why you can't send them an e mail asking them to let you play the songs royalty free on your specific 365 pod cast. Then if BMI comes after you, you can say you have the owner's permission and they can't say a damn thing. Personally, I never have a problem with that as long as the language doesn't open it up to other unintended commercial uses. Trust me, if someone's making money using my music. I want a cut baby. With pod casts, nobody's really making money and we may sell a few CD's out of it. win win. Spanky |

Spanky I just read something where bands can sign themselves up to a list of "podcasting safe bands". And then as long as podcasters pick bands from that list there is no trouble with "the man". If some Live365 operator like Ray had permission from all the bands to "broadcast" them royalty free, then yeah, what would be the problem? THIS IS THE LATEST EMAIL FROM LIVE365 Dear Live365 Broadcaster, As you may be aware, the Copyright Royalty Board recently issued alarmingly high new royalty rates for Internet radio for the period 2006-2010. The ruling increases sound recording royalties by 140% over four years and includes a $500 minimum fee per station per year. The new rates are so high that they exceed revenue generated from audio and visual advertising on our stations. See http://www.live365.com/choice/ for more information on the CRB ruling and what you can do about it. Although we are appealing the new rates, the outcome of an appeal will take some time. In the meantime, the new rates go into effect immediately and Live365 must pay higher rates retroactively from January 2006. We will not charge our broadcasters for any of these retroactive fees, but we do need to pay the additional royalties for the past 15 months and the future. We are taking several steps to help us recoup these fees, pay the new royalties, and keep down your broadcasting costs. In the past week, we have rolled out our "Are you still there?" campaign on a limited basis and confined most listening to our own ad-bearing Player Window. If an ad-based business model is to succeed, though, we need to find ways to generate more advertising revenues on our existing stations by serving more ads on more stations and selling ads for more money over wider stretches of time throughout the day. As one of the first such measures, beginning Thursday, March 29th, we will decrease ad block intervals from 15 minutes to 12 minutes -- so the frequency of in-stream ad blocks will increase approximately to five per hour. While we certainly recognize that this may have a negative impact on some non-paying listeners' listening experience, the impact is expected to be minimal, because each ad block is only around 60 seconds long. Eventually, we'd like to settle back down to three or four blocks per hour with two or three ads per block, when the Internet advertising market is ready to make this change and when we roll out a more powerful ad-insertion engine to handle multiple advertisers per block. We appreciate your understanding that without an ad-supported business model, broadcasting fees would be many times higher than it is today.
